Section 01

Agreement to Terms

By accessing or using the AnchorPointe Health website, submitting a contact or intake form, booking a consultation, or engaging with any of our services, you agree to be bound by these Terms & Conditions and our Privacy Policy.

If you do not agree to these terms, please do not use our website or services. These Terms constitute a legally binding agreement between you and AnchorPointe Health, LLC.

Section 02

SMS / Text Message Communications (A2P)

AnchorPointe Health operates an Application-to-Person (A2P) SMS messaging program in compliance with the CTIA Messaging Principles, 10DLC carrier requirements, and applicable federal and state laws including the Telephone Consumer Protection Act (TCPA).

Consent: By submitting your phone number and checking the SMS consent box on any AnchorPointe Health form, you expressly consent to receive recurring automated and manually dialed text messages from AnchorPointe Health at the mobile number provided.

Consent is not a condition of purchase. You are not required to consent to SMS communications to receive healthcare services from AnchorPointe Health.

To re-subscribe after opting out, text START to the same number or contact our support team directly. AnchorPointe Health reserves the right to modify or discontinue its SMS program at any time with notice.

Section 03

Telehealth Services

AnchorPointe Health is a telehealth scheduling and care coordination platform that connects patients with licensed, independent healthcare providers. All clinical decisions — including the prescribing of medication — are made solely by your treating licensed provider and are subject to their independent medical judgment.

Telehealth services provided through AnchorPointe Health are not a substitute for in-person emergency medical care. If you are experiencing a medical emergency, call 911 immediately or go to your nearest emergency room.

Submitting a contact form or booking a consultation does not by itself establish a patient-provider relationship. That relationship is established only upon your provider's acceptance of your case and the completion of a clinical intake.

Not Medical Advice

Content published on the AnchorPointe Health website — including blog articles, program descriptions, and FAQ responses — is provided for general informational purposes only. It does not constitute medical advice, diagnosis, or treatment recommendations.

Always consult a qualified, licensed healthcare provider before beginning any weight loss program, medication regimen, dietary change, or health intervention. Never disregard professional medical advice or delay seeking it because of something you read on this website.

Section 05

Eligibility

You must be at least 18 years of age to use AnchorPointe Health services. By submitting a form or booking a consultation, you confirm that you are 18 years of age or older and are legally permitted to receive telehealth services in your state of residence.

AnchorPointe Health currently serves patients in select US states. Availability is subject to change. Eligibility for specific programs and medications is determined by your treating provider based on your individual medical history and clinical criteria.

Section 06

No Guarantee of Results

Individual outcomes vary significantly. Weight loss results depend on many factors including but not limited to: adherence to the program, individual metabolism, lifestyle habits, co-existing health conditions, and medication response. AnchorPointe Health does not guarantee any specific weight loss outcome.

Testimonials or outcome examples described on this website are illustrative and reflect individual experiences. They are not a promise or guarantee that you will achieve the same results.

Section 07

Payments & Cancellations

Program fees are billed on a recurring monthly basis as disclosed at the time of enrollment. Pricing is subject to change with advance notice to active patients.

You may cancel your program at any time before the start of your next billing cycle at no cost. To cancel, contact your care coordinator or email [email protected]. Refunds for partial billing periods are not issued unless required by applicable law.

AnchorPointe Health is not responsible for the cost of medications prescribed by your provider, which are billed separately by the dispensing pharmacy. HSA and FSA funds may be used for eligible program expenses — consult your plan administrator for details.

HIPAA & Protected Health Information

AnchorPointe Health is a HIPAA-covered entity. All protected health information (PHI) you share with us is handled in strict accordance with our Notice of Privacy Practices and applicable federal and state law.

We implement administrative, physical, and technical safeguards designed to protect your health information from unauthorized access, use, or disclosure. Our platform partners and service providers are required to maintain equivalent safeguards under Business Associate Agreements (BAAs).

Your health information will not be used for marketing purposes without your separate, explicit written authorization.

Section 09

Intellectual Property

All content on the AnchorPointe Health website — including text, graphics, logos, icons, images, and page design — is the exclusive property of AnchorPointe Health, LLC and is protected by applicable US and international copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, transmit, repost, or otherwise use any content from this website without express prior written permission from AnchorPointe Health, LLC.

Section 10

Limitation of Liability

To the maximum extent permitted by applicable law, AnchorPointe Health, LLC and its officers, directors, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, revenue, or goodwill — arising from your use of or inability to use our website or services.

Our total cumulative liability to you for any claims arising under or related to these Terms shall not exceed the total amount paid by you to AnchorPointe Health in the thirty (30) days preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

Section 11

Indemnification

You agree to indemnify, defend, and hold harmless AnchorPointe Health, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in any way connected with: (a) your access to or use of our services; (b) your violation of these Terms; or (c) your violation of any rights of another person or entity.

Section 12

Governing Law & Dispute Resolution

These Terms & Conditions are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or your use of our services shall first be submitted to good-faith informal negotiation. If unresolved within 30 days, disputes shall be resolved by binding arbitration in Palm Beach County, Florida, under the rules of the American Arbitration Association (AAA). You waive any right to participate in a class action lawsuit or class-wide arbitration.

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm.

Changes to These Terms

AnchorPointe Health reserves the right to update or modify these Terms & Conditions at any time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will make reasonable efforts to notify active patients via email or SMS.

Your continued use of our services following any posted changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
